Refund Policy — Legal Reinforced Version

(Applicable to two separate entities: Maison Fleuret France — société de droit français, et Maison Fleuret USA — société de droit américain, État de New York.)

1. Cancellation and Refund Policy

We apply a tiered cancellation policy for the baking school and culinary journeys:

  • Cancellation 15 days before the workshop: 100% refund
  • Cancellation between 14 and 5 days before the workshop: 50% refund
  • Cancellation between 4 days before and the day of the scheduled experience: No refund, but rescheduling is possible

🇫🇷 2. Applicable Law — French Company (Maison Fleuret France)

Maison Fleuret France is a société de droit français. All transactions processed through this entity are governed by French law and applicable European Union consumer regulations, including:

2.1. Right of Withdrawal (EU Directive 2011/83/EU & Code de la Consommation)

Consumers have a 14-day withdrawal right under:

  • Directive 2011/83/EU on Consumer Rights
  • Articles L221-18 to L221-28 of the French Code de la Consommation

Exceptions include:

  • Article L221-28, 3°: services fully performed before the end of the withdrawal period
  • Article L221-28, 5°: supply of goods likely to deteriorate or expire rapidly (e.g., perishable baking kits)

2.2. Professional Obligations (France / EU)

Maison Fleuret France complies with:

  • Article L221-5 Code de la Consommation: mandatory pre-contractual information
  • Article L216-1 et seq.: delivery obligations
  • Article L121-1 et seq.: rules governing commercial practices and consumer protection

2.3. Refund Timing (France / EU)

Under Article L221-24, refunds must be issued within 14 days after withdrawal notification, unless the goods must be inspected first.


🇺🇸 3. Applicable Law — U.S. Company (Maison Fleuret USA — New York State)

Maison Fleuret USA operates under the jurisdiction of the State of New York (SoHo atelier). Purchases made through this entity are governed by:

3.1. New York State Consumer Protection Law

Relevant statutes include:

  • New York General Business Law (GBL) §§ 349–350: prohibition of deceptive acts and false advertising
  • GBL § 620–623 (Buyers' Remorse Law): cancellation rights in specific door-to-door sales (not generally applicable to workshops or online sales, but referenced for transparency)

3.2. Federal Trade Commission (FTC) Regulations

Maison Fleuret USA complies with:

  • FTC Act § 5: prohibits unfair or deceptive practices
  • FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435): governs timelines for shipping and refund obligations

3.3. U.S. Refund Practices

There is no federal mandatory refund law unless the seller chooses to offer one.
Maison Fleuret USA voluntarily adopts the same tiered cancellation policy as Maison Fleuret France to ensure fairness and clarity.


4. Exceptions / Non-returnable Items

Certain types of items cannot be returned, including:

  • Perishable goods (e.g., baking kits) — EU exception under Article L221-28, 5°.
  • Sale items
  • Gift cards


🇪🇺 5. EU 14-Day Cooling-Off Period (for shipments to the EU only)

If the merchandise is shipped to the EU, customers retain a 14-day withdrawal right, as mandated by:

  • Directive 2011/83/EU
  • Articles L221-18 et seq. Code de la Consommation

Returned items must be unused, in original condition, and accompanied by proof of purchase.


6. Refunds

You will be notified once your return is received and inspected. If approved, refunds will be issued to your original payment method within:

  • 10 business days (Maison Fleuret France) pursuant to standard commercial practice and Article L221-24 requirements
  • 10 business days (Maison Fleuret USA) in accordance with FTC refund expectations and reasonable industry standards
